Pennsylvania Attorney General Kathleen Kane lost her bid Tuesday to have the appointment of a special prosecutor looking into grand jury leaks dismissed by the state Supreme Court.
Kane challenged a county judge's appointment of lawyer Thomas Carluccio as special prosecutor, arguing it was not within the judge's authority.
The court, however, ruled the judge was acting within his authority.
The decision intensifies the possibility that Kane will face charges after a grand jury's recommendation of criminal charges against Kane for leaking secret material for political reasons.
A grand jury investigated accusations that Kane leaked information to the Philadelphia Daily News in an effort to embarrass political enemies.
Kane's fate now rests with the Montgomery County district attorney, who will decide whether to file charges.
