DJ Creato's lawyer still reviewing evidence in murder case

Haddon Township man accused of killing 3-year-old son

DJ Creato's lawyer asked Monday for more time to review evidence to prepare an "aggressive" defense of his client, who's accused of killing his 3-year-old son.

Richard J. Fuschino Jr., defense attorney for the Haddon Township father facing murder charges, said after the hearing that Creato is presumed innocent and that his team would do everything it could to prove he is innocent, the Philadelphia Inquirer reports.

Fuschino said he would be done reviewing the evidence soon.

In February, Creato, 22, pleaded not guilty to charges of killing his son, Brendan. Fuschino noted at the time that they were reviewing "voluminous" discovery information and that a trial could be a year or more away.

Brendan's body was found in Cooper River Park – about a half-mile from his father's house – on Oct. 13, 2015, about three hours after DJ Creato called 911 to report that his son was missing.

Prosecutors allege DJ Creato killed Brendan to maintain a relationship with his 17-year-old girlfriend, New York college student Julia "Julie" Spensky, 17, who lives in Bucks County, who had told him multiple times she did not like children.

Among the discovery information being reviewed by Fuschino are text messages sent between Spensky and Creato.

How many texts? More than 9,000 it has been reported.

Brendan's mother, Samantha Denoto, also attended Monday's hearing, but left without comment after it concluded, NJ.com reports. She had shared joint custody of the child with DJ Creato.

Creato remains in Camden County Jail after being unable to post $750,000 bail. Another hearing is scheduled for April 18.
